Netanyahu’s Fake Investigation to Evade ICC Arrest Warrant

Israeli Prime Minister Benjamin Netanyahu and Justice Minister Yariv Levin have purportedly made an extraordinary request to Attorney General Gali Baharav-Miara to initiate a fabricated criminal investigation targeting state leaders.

Reports from Israeli Channel 12 suggest that the objective of this contrived probe is to preclude the issuance of arrest warrants by the International Criminal Court (ICC).

By invoking the “principle of complementarity,” which permits states to circumvent ICC prosecutions if they are perceived to be conducting credible internal investigations into alleged crimes, Netanyahu and Levin aim to undermine potential ICC actions.

The strategy proposed by Netanyahu and Levin entails initiating an investigation only to promptly terminate it, thereby asserting to the ICC that Israel has addressed the issue through its own legal mechanisms.

Nevertheless, Attorney General Baharav-Miara dismissed this request, asserting that there was “no justification” for commencing such an inquiry.

The request comes in response to ICC prosecutor Karim Khan’s push to accelerate the issuance of arrest warrants against Netanyahu and Yoav Gallant.

These warrants are being pursued in light of the ongoing genocide in Gaza and war crimes by Israeli officials. Khan had urged the ICC to fast-track the proceedings in the face of the worsening situation.

Attorney General Baharav-Miara’s refusal has elicited accusations from Netanyahu’s allies, who contend that she is “sabotaging efforts.”

Despite these claims, legal experts and government officials argue that Netanyahu’s request is driven more by political motives than by any genuine concern for justice.
