DayofPal– The Israeli Supreme Court has ruled that international laws of war do not apply to Israel’s actions in Gaza, effectively granting legal immunity to the ongoing genocide.
In a unanimous decision, the court also dismissed a petition demanding the restoration of humanitarian aid to the besieged enclave.
Several justices argued that during the period under review, extending through March 2025, Israel’s conduct was guided by political directives and so-called “security considerations.”
The court further ruled that the Israeli government possesses absolute authority to determine the type and quantity of aid permitted into Gaza, a decision that flagrantly contravenes fundamental human rights and established tenets of international law.
Under international legal frameworks, an occupying power bears the obligation to ensure the unimpeded flow of humanitarian aid to civilians.
Yet, for over a year and a half, Israel has maintained a total blockade on Gaza, systematically depriving its population of food, clean water, and medical supplies. This siege has driven mass starvation and precipitated a humanitarian catastrophe of unprecedented scale.
Last year, the International Criminal Court (ICC) formally charged Israeli officials with weaponizing starvation against Gaza’s civilian population, allegations forming part of broader investigations into war crimes and crimes against humanity.
Since October 2023, Israel’s relentless military campaign, bolstered by unwavering support from the United States and Europe, has resulted in the deaths and injuries of over 164,000 Palestinians, the vast majority being women and children.
Despite mounting international condemnation, Israel continues to obstruct critical humanitarian aid deliveries, exacerbating the suffering of millions trapped under relentless bombardment and an escalating siege.
