On Monday May 20, the Islamic Movement of Hamas issued a statement regarding the ICC’s announcement of seeking arrest warrants against the Israeli Prime Minister and Israel’s War Minister, along with some Palestinian resistance leaders in Gaza.
Hamas strongly condemned the attempts by the Prosecutor of the International Criminal Court to equate the victim with the aggressor by issuing arrest warrants against a number of Palestinian resistance leaders. The warrants, it added, were issued without legal basis, thereby violating the treaties and United Nations resolutions that have greenlighted the Palestinians and all peoples under occupation and granted them the right to resist occupation in all forms, including armed resistance, especially in accordance with the United Nations Charter as stipulated in Article (51).
The statement slammed that the International Criminal Court’s announcement to request arrest warrants was issued only for two of the war criminals of the Zionist leader and came seven months late after the Israeli occupation committed thousands of crimes against humanity in Gaza and against Palestinian civilians.
“We demand that the Prosecutor issue arrest warrants for all war criminals among the leadership of the occupation, officers, and soldiers who participated in crimes against the Palestinian people,” the statement affirmed.
Hamas, in addition, demanded the cancellation of all arrest warrants issued against the leaders of the Palestinian resistance on the background of violating international treaties and resolutions.
Rather, it called on the Prosecutor to have issued arrest warrants against all responsible officials from the leadership of the Israeli occupation who gave the orders to the soldiers to commit in the bloody crimes in Gaza.
In the statement, Hamas revealed that the court should adhere to the Articles 25, 27, and 28 of the Rome Statute, which affirmed the individual criminal responsibility of every official, leader, or any person who ordered, incited, committed, assisted, or aided in the commission of crimes, or failed to take action to prevent their commission.
