On Tuesday April 30, 2024, the International Court of Justice has just rejected Germany’s request to suspend the hearing of Nicaragua’s lawsuit, proceeding to continue the case against it.
However, the Court has rejected to issue emergency measures over German arms sales to ‘Israel’ as requested by Nicaragua, which had argued that there was a serious risk of genocide in Gaza amid Israel’s assault on the Palestinian people.
The ICJ judges ruled against the request in a 15-1 vite, yet the ICJ judges expressed their grave concern over the serious conditions the Palestinians’ have been living through in Gaza.
“The circumstances are not such as to require the exercise of its power under article 41 of the statute to indicate provisional measures,” presiding Judge Nawaf Salam said.
The ICJ remains “deeply concerned about the catastrophic living conditions of the Palestinians in the Gaza Strip. In particular, in view of the prolonged and widespread deprivation of food and other basic necessities to which they have been subjected as acknowledged by the court in its order of March 28, 2024.”
Nicaragua argued during a two-day hearing earlier this month that Germany has breached the 1948 Genocide Convention and international law by supplying ‘Israel’ with arms sales, accusing Berlin that it’s well aware of the risk of genocide on Gaza.
Nicaragua also demanded that Germany resume funding to the UNRWA, the UN aid agency for Palestinian refugees, after ‘Israel’ alleged some of its employees were involved in the 7-October attacks.
Germany refuted Nicaragua allegations, with its lawyer contending that Nicaragua’s case was rushed, based on weak evidence, and should be dismissed for lack of jurisdiction.
Germany is currently one of Israel’s primary military suppliers, providing $353.7 million in equipment and weapons in 2023.
