Judges at the United Nations’ highest court are set to rule today on South Africa’s request for an order compelling ‘Israel’ to cease its Rafah offensive and withdraw from Gaza. This request forms part of a broader case accusing Israel of genocide, as reported by Reuters.
Last week, South Africa’s legal team urged the court to implement emergency measures, asserting that Israel’s assaults on the southern Gaza city must be halted to ensure the survival of the Palestinian population.
The International Court of Justice (ICJ) issues rulings that are final and binding, although these decisions have historically been ignored. The court lacks enforcement powers. ‘Israel’ has consistently dismissed the genocide accusations as unfounded.
An Israeli government spokesperson asserted yesterday that “no power on Earth will stop Israel from protecting its citizens and pursuing Hamas in Gaza.”

Several European nations declared yesterday their intention to recognize a Palestinian state. Additionally, the chief prosecutor of the International Criminal Court (ICC) announced on Monday that he had filed for arrest warrants against Netanyahu, Defense Minister Yoav Gallant, and Hamas leaders.
The ICC prosecutes individuals for alleged war crimes, crimes against humanity, and genocide, whereas the ICJ adjudicates disputes between states.
Previously, the ICJ has dismissed Israel’s request to discard the overarching case, ordering the country to prevent acts of genocide against Palestinians and to facilitate the flow of aid, without mandating a cessation of military operations.
Since October 7, 2023, ‘Israel’ has killed more than 35,800 Palestinians in Gaza and forcibly displaced over 70% of the enclave’s residents, many multiple times. It has now launched an offensive on Rafah, Gaza’s southernmost city, where it had previously directed Palestinians to relocate for their safety. Trapped within the besieged enclave, Palestinians have no refuge but the sea, which lacks fresh water and aid supplies.
